Website Terms and Conditions

1. About these terms

1.1 These Website Terms and Conditions (“Terms”) govern your access to and use of theworkplaceconsult.org and any page, form or advert that links to these Terms (together, the “Website”). The Website is operated by The Workplace Consult (“TWC”, “we”, “us”, “our”), registered with the Corporate Affairs Commission of Nigeria (registration number 7823694), of 28 Obanikoro Street, Obanikoro, Lagos, Nigeria.

1.2 By using the Website, or by submitting any form on it or on a third-party platform that links to these Terms (including a LinkedIn Lead Gen Form), you agree to these Terms. If you do not agree, please do not use the Website or submit our forms.

1.3 These Terms cover use of the Website only. Our consulting, HR technology, training and other services are provided under our Standard Terms of Business and the proposal, engagement letter or statement of work signed with each client. Nothing on the Website is an offer capable of acceptance; submitting a form is a request for information, and no contract for services exists until we confirm one in writing.

1.4 Any terms you propose that add to or conflict with these Terms do not apply unless we agree to them in writing.

2. Using the Website

2.1 Information only. Website content, including articles, guides, templates, webinars and the “Reintroducing Your Voice” series, is general information about HR practice. It is not legal, tax, financial or professional advice for your specific situation, and you should take advice before acting on it. We try to keep content accurate and current but do not promise that it is complete, error-free or always available.

2.2 Acceptable use. You must not: use the Website for any unlawful purpose; introduce viruses or malicious code; attempt unauthorised access to the Website, its servers or data; scrape, harvest or bulk-download content or contact details; submit false information or someone else’s details without their authority; or use the Website to send spam or unsolicited advertising.

2.3 Forms and adverts. When you submit a form on the Website or through our adverts (including LinkedIn Lead Gen Forms), you confirm the information is accurate and that you are authorised to share it, including on behalf of your organisation. We use what you submit as described in our Privacy Policy. Marketing messages are sent only if you opt in, and you can unsubscribe at any time.

2.4 Downloads and free resources. Templates, guides and toolkits we make available for download are licensed to you for your own internal use. You may adapt them for your organisation but may not sell, republish or present them as your own work.

2.5 Intellectual property. TWC owns, or is licensed to use, all content, designs, logos, frameworks and trademarks on the Website. You may view, print and share pages for personal or internal business use with attribution to TWC. Any other copying or commercial use needs our written permission. Third-party names and logos (for example of HR software vendors we work with) belong to their owners and appear for identification only.

2.6 Third-party links. The Website may link to vendor, partner, event or other third-party sites. We do not control them and are not responsible for their content, products, availability or privacy practices. A link is not an endorsement unless we say so.

2.7 Availability. We may change, suspend or withdraw any part of the Website at any time without notice, and may restrict access for anyone who breaches these Terms.

3. Liability

3.1 The Website is free to use and is provided “as is”. To the extent the law allows, TWC is not liable for any loss arising from your use of, or reliance on, the Website or its content, or from the Website being unavailable, including loss of profit, business, data or goodwill.

3.2 Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or any liability that cannot be excluded by law. If you use the Website as a consumer, nothing in these Terms affects your rights under the Federal Competition and Consumer Protection Act 2018.

3.3 You agree to indemnify TWC against losses and reasonable costs arising from your breach of section 2.2 or your misuse of the Website.

4. Privacy

Our Privacy Policy explains how we collect and use personal data through the Website, our forms and our adverts, and your rights under the Nigeria Data Protection Act 2023.

5. Governing law and disputes

5.1 These Terms are governed by the laws of the Federal Republic of Nigeria.

5.2 We encourage you to contact us first so we can try to resolve any concern informally. Otherwise, the courts of Nigeria have jurisdiction, with Lagos State as the venue where the law permits.

5.3 Nothing in these Terms limits your right to complain to the Nigeria Data Protection Commission or to seek redress in a Nigerian court for a breach of your data privacy rights.

6. General

6.1 Changes. We may update these Terms from time to time. The version on this page, with its effective date, applies each time you use the Website.

6.2 Severability. If a court finds any provision unenforceable, the rest of these Terms continue in force.

6.3 No waiver. If we do not enforce a provision straight away, we can still enforce it later.
